While NSFOC weighs the options on whether or not to appeal Judge Popejoy's decision to honor D204's request to dismiss the NSFOC and Plaintiffs' complaint about broken promises, taxpayers should note that the legal fees now claimed by the Brach-Brodie lawyers, for walking away from the Brach-Brodie land promoted during the 2006 Referendum process, are estimated at $5 million. |

D204 Motion To Dismiss SuccessfulMay 30, 2008
District 204's Motion to Dismiss (MTD) the NSFOC and other Plaintiffs' complaint was honored by Judge Popejoy. As you may have heard by now, he dismissed the complaint based on NSFOC and Plaintiffs not having legal standing to bring the complaint in the first place. Obviously, we are very disappointed, but not completely surprised with the decision. |

School district leaders all over the nation are worried about rising fuel prices consuming budgets. Since the beginning of the year when average diesel fuel prices were already 33% higher than last year, that gap has widened to over 53% higher than last year. What does this mean for D204? Brach Estate Files Its First Lawsuit Against D204May 13, 2008
The Brach Estate filed it's long-awaited lawsuit against IPSD 204. This is now the fourth lawsuit pending against the school district based on their own decision-making and actions. See the full Sun Article here. Unfortunately, the Sun did not go into a lot of detail. NSFOC has estimated that this lawsuit would have the same impact as the first Brodie Trust lawsuit (the 50% partner). Brodie lawsuit II regarding the failed $40M deal with PREIT and NSFOC are the other two lawsuits. Brach could cost D204 $11 million (est.). Don't Mistake Quiet For NSFOC Inactivity
May 11, 2008
NSFOC is still working hard...behind the scenes, to do everything possible to stop D204 from breaking its promises that you voted YES for in the 2006 Referendum. NSFOC is working for you - it's all legal and political at this point. We won once. We'll win again. Don't mistake quiet for inactivity. |
